Massage Therapy REQUIRED LICENSES

Legal Structure

Whether an Massage Therapy online, home, store, concession stand or a mobile cart, you will need to first select among solesole owner/proprietor, partnership, LLC or corporation, all of which also require a General Business License (not a specific license to your type of business) as well. If your trade name is a business name other than your full personal legal name, you will need to file a DBA . For instance, your name is John Doe, and you do business as Best Massage Therapy By John, the name must be registered with aDBA Biz Name because it is not your full legal name. Also, note that whatever item that you sell or lease and it is an item that can be touched (i.e., tangible such as equipment, toys, merchandise, electronics, prepared food) requires a state sales tax ID ( Sellers Permit ) to either buy or sell the items or products wholesale and or sell them retail. If you are hiring workers anytime soon, you will need aFederal EIN and a State EIN (employer identification number). Other instances that you will need a federal tax ID are: if you are a partnership, an independent contractor, and a corporation or anLLC . You can also obtain a federal tax ID as a Massage Therapy sole proprietor and use it as a business tax ID in the place of a social security number. However, you will still need other registrations, such as licenses, an assumed business name DBA, and tax IDs as described above. Finally, even one person, Massage Therapy sole owner/proprietors working from home or just online can form a LLC or incorporate, in which case, they will not need to file a DBA.exactly how do go about getting a license for massage therapy? i dont sell anything, im trying to figure out what i need to get started on a massage therapy home business I'm looking to start a massage business in Boulder. Keep in mind that requirements can vary significantly based on your location (city, state, country), so it's crucial to check with your local government and professional regulatory bodies for the most accurate information.

Research Local Regulations and Zoning Laws

  • **Contact your local city or county government** to inquire about zoning laws for operating a business from your home. Some areas may have restrictions or require special permits for home-based businesses.

  • **Health Department Regulations:** Since massage therapy involves physical contact, your local health department may have specific guidelines or inspections to ensure a safe and hygienic environment.

  • Obtain Professional Certification

  • **Complete an accredited massage therapy program.** Most states or countries require massage therapists to complete a program from an accredited institution, which typically includes both coursework and hands-on practice.

  • **Pass a recognized certification exam,** such as the Massage and Bodywork Licensing Examination (MBLEx) in the United States, depending on your jurisdiction's requirements.
  • Apply for Licenses and Permits

  • **State or Provincial License:** Apply for a massage therapist license from your state or provincial board. This often requires submitting proof of education, passing a background check, and paying a fee.

  • **Business License:** Obtain a business license from your local government. This may involve filling out an application, paying a fee, and providing details about your business.

  • **Home Occupation Permit:** If required by your local zoning laws, you may need to obtain a permit to legally operate a business from your home.

  • **Employer Identification Number (EIN):** If you plan to hire employees, you'll likely need an EIN from the IRS (or equivalent organization in your country) for tax purposes.

  • Insurance and Liability Protection

  • **Professional Liability Insurance:** Also known as malpractice insurance, this protects you in case of lawsuits alleging negligence or harm from your services.

  • **General Business Insurance:** Covers accidents or injuries that might occur on your property not directly related to the massage services.

  • Prepare Your Home and Business

  • **Create a dedicated, professional space** for your massage therapy business that complies with health and safety standards.

  • **Purchase necessary equipment and supplies,** such as a massage table, linens, oils, and sanitizing products.

  • **Set up a business phone line and professional email address** to communicate with clients.

  • Marketing and Client Management

  • **Develop a website and social media presence** to promote your services and attract clients.

  • **Consider using online scheduling and client management software** to streamline bookings and maintain client records.

  • Continuous Education and Compliance

  • **Stay updated on industry standards** and continue learning new massage techniques and modalities.

  • **Renew your licenses and certifications** as required by your state or professional board to ensure you remain in good standing.

  • Starting a massage therapy business from home involves navigating through a maze of regulations and preparations to ensure legal compliance and professional success.

You can choose to be a(n) Massage Therapy Pain Relief :

    • Sole Proprietor,
    • LLC,
    • Corporation or
    • Partnership.
After you decide and select your business entity, you need licensing.

Charlotte Business Tax Registration ( Business License)
All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.

A(n) Massage Therapy Pain Relief business using a fictitious business name in City Of Charlotte &Amp; Mecklenburg County i.e. you are a business with a trade name other than the owner's legal (full name) name are required to get a(n) fictitious business name. ย  For instance you open a(n) Massage Therapy Pain Relief business and you name it "Superior Massage Therapy Pain Relief Group". You will need to file a fictitious business name for that name.

In NC you need a resale ID ( AKA seller's permit) if you selling touchable items. ย (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states).
    Seller's Permit

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.

Also keep in mind that employers will need to obtain a federal EIN and a State EIN tax identificattion number. I.e., a NC Federal Tax Id Number ($29) ย and a(n) NC ย State Employer Tax Numberย ย

Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Charlotte,ย Incorporate in NC ย orย form a(n) NC LLC
    .ย

You have a choice to file a DBA or form an LLC or incorporate. If you will do business under your first and last legal name you will not need to get a fictitious business name.
Using any language that connotes additional owners in the name of the business makes filing a fictitious business name mandatory.

If you do form an Massage Therapy llc or incorporate (about $49 plus state fees for most states) your Massage Therapy Pain Relief business instead of just filing a fictitious business name (dba), that insurs that you don't have personal liability for debts and civile liabililty arising from your business dealings and you will not have to record the Charlotte business name. In lieu of recording a City Of Charlotte &Amp; Mecklenburg County trade company name (our filing service fee includes trade name registration and newspaper legal publication for 4 weeks) you can also form a corporation in NC or form an NC LLC (starts @ $49 plus state fee for most states & includes required documents such as bylaws for the corporation and Limited Liability operating agreement for the LLC). .
